Terms of Service
These terms govern your use of Sentink’s services and website. By accessing or using Sentink, you agree to these terms. If you are using Sentink on behalf of an organization, you confirm you have authority to bind that organization.
The service
Sentink provides online survey, feedback, analytics, and related features. We may add, change, or retire features. We will try to give reasonable notice for material changes that affect you.
Accounts and eligibility
You must provide accurate registration information and keep it updated. You are responsible for all activity under your account and for maintaining the security of your credentials.
Acceptable use
You will not use Sentink to break the law, harm others, send spam, phish, distribute malware, harass respondents, or scrape or overload our systems. You are responsible for your survey content and for obtaining any consent you need from respondents.
Customer data and surveys
You own your content and instructions. You give Sentink a license to host, process, and display your content only to provide the service. You are responsible for compliance with privacy and employment laws for your use cases.
Plans, fees, and taxes
Fees are as shown in your order or plan. Unless stated otherwise, fees are exclusive of applicable taxes. Late or failed payments may result in suspension of service. Upgrades and downgrades follow the plan rules shown at purchase.
Service levels and support
We aim for high availability but do not guarantee uninterrupted service. Support scope depends on your plan. We may need access to your account information to help you.
Intellectual property
Sentink’s software, brand, and documentation are protected. Except for the rights explicitly granted, no rights are transferred to you. Feedback you give us may be used without obligation to you.
Limitation of liability
To the maximum extent permitted by law, Sentink is not liable for indirect, incidental, or consequential damages, or for loss of profits, data, or goodwill. Our total liability for a claim is limited to the fees you paid to us in the twelve months before the event giving rise to the claim, except where the law does not allow such limits.
Indemnity
You will defend and indemnify Sentink against claims arising from your content, your surveys, or your breach of these terms, except to the extent caused by Sentink’s willful misconduct.
Suspension and termination
We may suspend or terminate access for material breach, risk to security, or law. You may close your account as described in the product. Provisions that should survive (for example, liability limits) survive termination.
Governing law
Unless a separate agreement with your organization says otherwise, these terms are governed by the laws of the Federal Republic of Germany, and courts in Berlin, Germany, have exclusive jurisdiction, without prejudice to any mandatory rights you have in your country of residence as a consumer.
